SC: Maintenance Rights of Wife and Children Override Creditors' Claims

In Apurva v. Dolly (2024 INSC 1014), the Supreme Court held that maintenance rights of a wife and children under the Code of Criminal Procedure, 1973 (now BNSS) have overriding effect over the claims of secured creditors under the SARFAESI Act, 2002 and the Insolvency and Bankruptcy Code, 2016. The Court held that the constitutional obligation to protect the maintenance rights of dependents cannot be subordinated to commercial recovery mechanisms, even where the husband's assets are subject to secured creditor claims.
