NCLAT Clarifies Operational Debt Scope and Moratorium Rules

The National Company Law Appellate Tribunal delivered key rulings addressing two important IBC questions: the scope of what constitutes an "operational debt" for the purpose of Section 5(21) of the Insolvency and Bankruptcy Code, 2016, and the extent of moratorium protection under Section 14 for the corporate debtor during the CIRP process. The rulings provide important guidance for insolvency professionals and operational creditors on standing to file CIRP applications and the protection available to corporate debtors during resolution proceedings.

Why it matters: Operational creditors frequently face challenges in establishing that their claims qualify as operational debt under the IBC. These rulings clarify the boundaries, affecting the standing of suppliers, service providers, and other operational creditors to initiate or participate in insolvency proceedings.
