The Supreme Court held that the denial of childcare leave to women government employees violates their fundamental right to equality under the Constitution. The Court observed that childcare leave provisions, where they exist in service rules, must be implemented in a manner that upholds the constitutional commitment to gender equality and the recognition of women's dual role as professionals and primary caregivers.

Why it matters: This ruling elevates childcare leave from an administrative benefit to a constitutionally protected right. Government departments and PSUs must review their leave policies to ensure compliance. The decision also strengthens the broader gender equality jurisprudence and may influence private sector leave policy development.
