SAT Overturns SEBI on Insider Trading Generally Available Test

The Securities Appellate Tribunal, in FCRPL v. SEBI, overturned SEBI's insider trading finding after ruling that the regulator had misapplied the "generally available information" test under the SEBI (Prohibition of Insider Trading) Regulations, 2015. The SAT held that the information in question met the threshold of being generally available to market participants, and therefore could not constitute unpublished price-sensitive information (UPSI) for the purpose of insider trading charges.
