The April 2023 amendment to the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 empowering a government-designated Fact Check Unit (FCU) to identify online content as 'fake or misleading' with respect to the business of the Central Government continued to generate significant legal debate. Under the amendment, online intermediaries must take down content identified by the FCU or risk losing their safe harbour protection under Section 79 of the IT Act. Critics argue the provision amounts to government censorship and violates Article 19(1)(a) guarantees of free speech.
